Litigation Challenges JKPSC’s Reconstitution Before HC risingkashmir.com
Fresh litigation challenging the government order for the reconstitution of the Jammu Kashmir Public Service Commission (JKPSC) was moved before the High Court on Thursday. The General Administration Department (GAD) on November 21, 2019, had issued an order for reconstitution of the commission and said the order was sent to JKPSC, Jammu. The petition filed by General Secretary, Abdul Rashid Tantray of Moulana Azad Educational Trust through his counsel Manzoor Ahmad Ganie states that the GAD has interpreted section 93 of the JK Reorganisation Act 2019 “as if the Chairman and members of the commission were to function only till the appointed day”.
It says the impugned order is both “substantially as well as procedurally unreasonable” as only the president could issue an order or do anything under the provision of the act in case of difficulty, which arises in giving effect to the provisions of the act. “However, the order is issued by the incompetent authority, GAD, which is preparing to initiate a fresh exercise for reconstitution of the PSC,” it says.
